1. Who we are

ItalyGo ("ItalyGo", "we", "us") is an online discovery platform that showcases Italian restaurants, cafés, bakeries, bars, food shops and related experiences across Ontario, Canada. The platform is operated by MM Creativity, Ontario, Canada. By using italygo.ca (the "Site") you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the Site.

2. The Service

ItalyGo provides:

  • a directory of Italian businesses and experiences, with editorial and community content;
  • community features — reviews, photos, check-ins, favourites, lists and the Italian Passport program;
  • tools for business owners to claim and manage their listings.

ItalyGo is not a reservation or booking service. Where a "Book a table", "Reserve" or similar button appears, you are sent to the business or an external booking provider. Any reservation, order, payment or agreement you make is strictly between you and that business. ItalyGo is never a party to it, never processes payments, and assumes no responsibility for it.

3. Business information — no guarantee

Listings, hours, prices, menus, addresses and websites are compiled from public sources, business submissions and community contributions, and may be incomplete, outdated or inaccurate. Always confirm details (especially hours and availability) directly with the business before travelling. Inclusion in the directory is not an endorsement, and exclusion is not a negative judgment. Excellence Index scores and any badges are editorial opinion and community feedback, not verifiable statements of fact.

4. Your account

  • You must provide accurate information and keep your credentials confidential.
  • You are responsible for all activity under your account.
  • You must be at least 13 years old to create an account.
  • We may suspend or delete accounts that violate these Terms or the Community Guidelines.

5. Your content (reviews, photos, check-ins)

You keep ownership of everything you submit. However, by submitting content you grant ItalyGo a worldwide, royalty-free, perpetual, transferable licence to host, store, reproduce, adapt, translate, publish, display and promote it as part of the Site and its marketing. This licence continues even if you later delete the content or your account, though we will make reasonable efforts to remove it from the Site on request.

You represent and warrant that content you submit:

  • is your own work or you have the right to submit and license it;
  • does not infringe any copyright, trademark, privacy, publicity or other right;
  • is truthful to the best of your knowledge and based on your genuine experience;
  • does not contain unlawful, defamatory, hateful, harassing or sexually explicit material;
  • does not contain other people's personal information without their consent.

You alone are responsible for your content. We do not pre-screen submissions, but we may edit, hide or remove any content at any time at our discretion, without notice.

6. Business listings, logos and trademarks

Business names, logos and photos are used solely to identify and promote those businesses on the Site. All trademarks remain the property of their respective owners. Business owners who object to their listing, logo or imagery may contact us and we will review, amend or remove it. Claimed listings must be managed only by the actual owner or an authorised representative; false claims are grounds for permanent removal.

7. Italian Passport, badges and rewards

Passport stamps, badges, levels and leaderboard positions are promotional features with no monetary value. Business rewards are offers made by the participating business, subject to that business's own conditions, and may be changed or withdrawn by the business at any time. ItalyGo does not guarantee any reward. Manual check-ins are made on the honour system; we may introduce verification at any time and may reverse stamps obtained abusively.

8. Acceptable use

You agree not to:

  • scrape, copy, resell or create derivative databases from the Site's content without written permission;
  • use automated systems to access the Site without our express consent;
  • interfere with the Site's operation, security or other users' enjoyment;
  • impersonate any person or business, or misrepresent an affiliation;
  • submit fake reviews, paid-for reviews presented as independent, or content about a business you have not genuinely experienced;
  • use the Site for any unlawful purpose.

9. Intellectual property

The Site's design, text, graphics, code, database and branding (excluding business trademarks and user content) are owned by or licensed to ItalyGo and protected by Canadian and international law. You may share links freely; you may not reproduce substantial parts of the Site without permission.

10. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ITALYGO AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE, ANY THIRD-PARTY BOOKING, OR ANY INTERACTION WITH A BUSINESS FOUND THROUGH THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED CAD $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS LOWER. Some jurisdictions do not allow certain limitations; in that case these limits apply to the maximum extent permitted.

12. Indemnification

You agree to indemnify and hold harmless ItalyGo and its operators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your content, your use of the Site, or your violation of these Terms or of any third party's rights.

13. Termination

We may modify, suspend or discontinue any part of the Site at any time. We may terminate your access at any time for any reason, including breach of these Terms. Sections 5, 9, 10, 11 and 12 survive termination.

14. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute will be brought exclusively before the courts of Ontario, Canada.

15. Changes to these Terms

We may update these Terms at any time by posting a revised version with a new "Last updated" date. Continued use of the Site after changes means you accept the revised Terms.
